Our attorneys fully recognize and appreciate that the successful handling of such claims involves strong litigation skills combined with an appreciation of the business realities and practicalities that are necessary to resolve claims efficiently and cost-effectively. Over the years, our attorneys have developed a substantial collection of pleadings, briefs, articles and other material that assist in providing cost-effective services.

Covering all of New England as well as several adjoining states, Cetrulo & Capone LLP's surety attorneys have handled claims involving most types of surety bonds, including payment and performance bonds, bid bonds, probate, license and permit, subdivision and other miscellaneous bonds. We regularly review, negotiate and litigate many of the issues that commonly confront sureties. The following is a broad outline of the types of matters that are regularly handled:

  • Defense of sureties in litigation ranging from default of general contractors and subcontractors, to multi-party construction litigation involving a wide variety of construction projects;
  • Negotiation and drafting of take-over, re-let and tender agreements for sureties on both public and private projects;
  • Representation of sureties in all phases of payment bond claims, including the investigation and negotiation of such claims;
  • Representation of sureties on bid bonds, probate, license and permit, subdivision and other miscellaneous bond claims;
  • Defense of sureties on both bad faith and lender liability claims;
  • Representation of sureties in actions against indemnitors; and
  • Preparation of documents utilized by the surety industry such as payment and performance bond and indemnity agreements.

As part of our dedication to the surety industry, our attorneys regularly participate in seminars on the surety industry. In particular, our attorneys have written and spoken before the Fidelity and Surety Law Committee of the American Bar Associations, Tort and Insurance Practice Section, National Bond Claims Association, the Surety Claim Institute, the Fidelity and Surety Committee of the International Association of Defense Counsel, the National Association of Independent Sureties and the New England Bond Claims Association. In addition, our attorneys have authored articles for the American Bar Association and other organizations involving the handling of performance bond claims and miscellaneous bond claims.
