Our representation of clients on environmental matters is both by way of direct representation of private clients and by way of referral of the defensive environmental claims from insurance carriers. Our attorneys have participated in all aspects of negotiation with the United States Environmental Protection Agency, the Massachusetts Department of Environmental Protection and other similar federal and state agencies on behalf of owners, operators, generators and transporters. Cetrulo & Capone LLP has both prosecuted and defended claims by private owners against persons allegedly responsible for existing or threatened on-site contamination. Also, Cetrulo & Capone LLP has extensively engaged in environmental coverage litigation in the trial and appellate level of the state and federal courts.
The focus of our attorneys in this area, as in other areas of the practice, is to determine at as early a stage as practicable the extent and nature of the client's exposure and, wherever possible, to seek to terminate the client's involvement in the particular matter at the minimum possible cost consistent with obtaining the client's stated goals and objectives. The firm's approach in environmental matters is to seek negotiated solutions to problems wherever possible, but also to negotiate from the strongest possible position based upon a realistic evaluation of the case and the willingness, if necessary, to engage in aggressive litigation to obtain the client's objectives should those objectives not be attainable through negotiation.
